GST Registration for Foreigners

GST Casual Taxable Person registration for foreign companies at Indian exhibitions and events — or regular GSTIN for foreign entities with permanent Indian establishment.

5.0 / 5.0

Overview

Foreign companies and non-resident persons supplying taxable goods or services in India on a temporary basis must obtain a Casual Taxable Person (CTP) registration under Form GST REG-09, at least 5 working days before commencing business. CTPs must make an advance deposit of the estimated GST liability for the entire registration period in cash before operations begin. The CTP registration is valid for 90 days (extendable by another 90 days).

Foreign companies with a permanent establishment, branch office, or liaison office in India making taxable supplies require a regular GSTIN through their Indian entity. Foreign companies supplying OIDAR (Online Information and Database Access or Retrieval) services — digital downloads, SaaS, streaming — to Indian consumers must also register and pay GST at 18% on B2C sales. MFiling handles both CTP registrations for foreign event participants and regular GSTIN applications for foreign entities with Indian operations.

MFiling professional charges: from Rs.4,999 for CTP registration; from Rs.7,999 for regular GSTIN for foreign entities.

Frequently Asked Questions

Does a foreign company need to obtain a PAN to register for GST in India?
Yes. For regular GSTIN, a PAN is mandatory. Foreign companies must apply for PAN in India (Form 49AA) before GST registration. However, for CTP (Casual Taxable Person) registration, Section 25(9) provides an exception — non-resident taxable persons may be granted registration based on their Tax Identification Number from their home country, without requiring Indian PAN. MFiling assists with both PAN application and CTP registration for foreign entities.
Is GST applicable on digital services sold by a foreign company to Indian consumers?
Yes. Under OIDAR (Online Information and Database Access or Retrieval) provisions, foreign companies providing digital services — streaming, SaaS, online courses, e-books, app downloads — to Indian consumers (B2C) must register in India and pay GST at 18%. For B2B supplies, the Indian recipient pays GST under Reverse Charge Mechanism (RCM) and no foreign registration is required. MFiling handles OIDAR GST registration and compliance for foreign digital service providers.
