Company ITR Filing

ITR-6 filing for domestic and foreign companies — 115BAA new regime analysis, MAT computation, advance tax reconciliation, and Transfer Pricing compliance.

5.0 / 5.0

Overview

All domestic and foreign companies registered in India (except charitable Section 8 companies) must file ITR-6 annually. Tax audit is mandatory for all companies regardless of turnover. The due date is October 31 for companies requiring audit (which is all companies) and November 30 for companies with international transactions requiring Transfer Pricing audit.

Corporate tax planning centres on the choice between the Section 115BAA new tax regime (effective 22% tax — no deductions/exemptions but no MAT) and the regular regime. Once opted into 115BAA, the company cannot revert. Companies under the regular regime are subject to MAT (Minimum Alternate Tax) at 15% of book profit if their normal tax is lower. MFiling prepares the complete Schedule BP, MAT computation, TDS reconciliation with 26AS, and advance tax analysis.

MFiling professional charges: from Rs.4,999 (small company, no transfer pricing) | Rs.9,999 (audit + transfer pricing).

How it Works

Review Audited Financials and Tax Audit Report (Week 1)

Review Form 3CA/3CD for any adjustments, disallowances, or qualifications requiring attention.

Compute Taxable Income (Schedule BP) (Week 1–2)

Prepare business income computation — depreciation adjustment, disallowances, deductions under Chapter VI.

Calculate MAT (if applicable) (Week 2)

Compute 15% of book profit under Schedule MAT — compare with regular tax.

Reconcile TDS Credits with 26AS (Week 2)

Match all TDS certificates with 26AS data — identify mismatches before filing.

Verify Advance Tax Payments (Week 2)

Confirm all four quarterly advance tax payments and calculate 234C interest if shortfall exists.

Prepare Transfer Pricing Report (if applicable) (Week 2–4)

Prepare TP documentation and Form 3CEB for international related-party transactions.

File ITR-6 with DSC of Director (Before October 31)

Submit ITR-6 on income tax portal using DSC of the director authorised by board resolution — by October 31.

Frequently Asked Questions

What is the difference between Section 115BAA and the regular corporate tax rate?
Section 115BAA offers a flat 22% tax rate (effective 25.17% with surcharge and cess) with no MAT obligation. The trade-off is the permanent surrender of most deductions — no Section 80IC, 80IE, investment allowance, R&D deduction, or accumulated MAT credit. The regular rate for companies with turnover up to Rs.400 crore is 25%. Once opted into 115BAA, a company cannot opt out. MFiling advises on the long-term tax implication before making this irrevocable choice.
Is a company required to file ITR even if it has made no income during the year?
Yes. All companies registered in India must file ITR-6 annually regardless of whether they have any income, expense, or activity. A company with no income files a nil return — non-filing attracts a late fee under Section 234F (Rs.1,000 to Rs.5,000) and may attract scrutiny. Additionally, companies with losses must file ITR to carry forward those losses — they cannot be carried forward if the return is filed after the due date.
