12A Registration

Standalone 12A registration for NGOs — income tax exemption on surplus income under Sections 12A/12AB of the Income Tax Act, 1961.

5.0 / 5.0

Overview

Section 12A Registration (now 12AB under the Finance Act 2020) exempts the income of a charitable or religious trust or institution from income tax. Without 12A registration, the NGO's entire income — including grants, donations, and programme income — is taxable at the applicable rate. With 12A registration, the surplus after application of income to charitable objects is fully exempt from tax.

Eligible organisations include Public Charitable Trusts, Registered Societies, and Section 8 Companies with objects confined to charitable or religious purposes. The new regime (effective April 2021) requires provisional registration (Form 10A) first for new NGOs, valid for 3 years, followed by permanent registration (Form 10AB) after 3 years of operations and audit reports. MFiling prepares the Form 10A application, reviews objects clause alignment with eligible charitable purposes, and manages Income Tax portal filings.

Government fee: Nil. MFiling professional charges: from Rs.9,899.

Frequently Asked Questions

What happens if an NGO operates without 12A registration?
Without 12A registration, the NGO's surplus income is taxable at 30% (for societies/trusts) or at company tax rates (for Section 8 companies). Additionally, donors cannot claim 80G deduction without the NGO having 12A. Operating without registration results in significant tax outflow that reduces funds available for charitable activities.
What is the difference between provisional and permanent 12A registration?
Provisional registration under Form 10A is granted to new NGOs for 3 years without requiring financial records. Permanent registration under Form 10AB is granted after 3 years of operations with audited financial statements, activity reports, and proof of charitable purpose. Permanent registration is valid for 5 years and must be renewed thereafter.
